Efficiency of Legal Regulation: the Framework of Cultural Codes and Civilizational Values
Abstract
The article considers the problems of achieving the objectives of legal regulation and the impact on this process of not only the legal awareness of the participants of legal relations, but also civilizational values, reference points of their quintessentials in the form of cultural codes. The analysis is given to the effectiveness of legal regulation, taking into account the national-cultural and civilizational specifics of particular people; the influence of the features of national sense of justice and worldview on the effectiveness of the law. The factor hindering the achievement of the objectives of the right regulation, which the legislators set for themselves, is legal psychology. The content of legal ideology is determined by the level of socio-economic development; the authority of the systems of state power, the social structure and national traditions. Ideally, the process of lawmaking should contain a stage of monitoring the effectiveness of the application of legal norms, the purpose of which is to assess the extent to which the results of legal regulation have been achieved. This stage should encourage the legislator to improve the norm, if the objectives of legal regulation for one reason or another have not been achieved.
