Possible Ways of Improving the Mediation Process in the Russian Federation at the Present Stage
Abstract
Over the last decade in the Russian Federation there is a systematic and progressive development of the civil and civil-procedural legislation with a view to improve its efficiency and effectiveness. One of the most progressive aspects in this area was the introduction of an alternative procedure for the settlement of legal disputes with the participation of an intermediary (mediation procedure) into the legal field of Russia and consolidation at the legal level. Since the adoption of the Federal law of July 27, 2010 № 193-FZ "“On the Alternative Procedure for the Settlement of Disputes with the Participation of a Mediator (mediation procedure)” enough time has passed to analyze the existing problems in the practical application of mediation as the main alternative to judicial settlement of legal disputes and to determine the possible prospects for its development. In this context, the authors of the present article reasonably determine the existing organizational and legal obstacles to the formation of the mediation procedure as an effective out-of-court (alternative) method of settlement of legal disputes. The authors conclude that the mediation procedure occupied a certain niche in the legal field of Russia. The authors pay special attention to possible legislative innovations to improve the use of mediation procedures in the Russian Federation in the short and long term as the main alternative to judicial settlement of legal disputes.
