Positions of Russian Civilists on the Definition of the Concept “Physical Person”: Retrospectives and Modernity
Abstract
The article attempted to determine the essence of a natural person from a perspective of the pre-Soviet Russian jurisprudence. The basis is the scientific works of the classics of the Russian civil law: N.L. Duvernua
G.F. Shershenevich, E.N. Trubetskoi. The author uses an original understanding of the subject of law, when an individual and natural person are different. A natural person is considered as legal personality of an individual, his ability, legal means of his activity. The observations and conclusions made by the author are attributed to current problems of practice in the field of inheritable relations (the problem of “hereditas jacens“), copyright (the problem of protection of the right and name of a dead author). The property rights of the testator after his death shall be retained by the natural person of the testator until the transfer of these rights to the heirs. The personal rights of the deceased, which cannot be transferred to the heirs, belong to the natural person of the deceased person. Thus, it is possible to abandon the use of the doubtful category of "rights without a subject". The mechanism of succession in inheritance, when there is a gap in time between the death of the testator and the entry of heirs into inheritance is explained.
