Investigation Activity as a Constitutional Guarantee of Obtaining Evidence at Preliminary Investigation
Abstract
The improvement of the effect of the preliminary investigation to a considerable extent is connected with collecting legal evidence where the main way of their obtaining is investigation activity.
At present the Criminal and Legal Procedure Code of the Russian Federation as well as the Criminal and Legal Procedure Code of the Russian Soviet Federation of Socialist Republics does not give a precise definition of the notion “investigation activity” The article pays attention to the gaps of legal regulation of this kind of activity arising which result in some difficulties in legal and applicable practice. The authors formulated the proposals on the improvement of the present legal procedure legislation.
First of all the implementation of investigation activity is connected with considerable interference of the State into the sphere of personal rights and legal interests of its citizens.
It is how the law regulates the grounds, and the procedure for conducting investigative actions, that determines the effectiveness of solving the tasks of criminal justice.
Since the Constitution of the Russian Federation proclaimed that people, their rights and freedoms are the highest values, the authors propose to rename Chapter 25 of the Code of Criminal Procedure of the Russian Federation as follows: “Investigative Actions Affecting the Constitutional Rights and Freedoms of a Person.” The authors of the article point out the significance of investigative actions directly related to the restriction of constitutional human rights and freedoms.
In the article they also consider the significance of securing legal and real fundamentals of investigation activity in the Criminal and Legal Procedure Code of the Russian Federation.
