Problems of Crime Investigation within the Competence of the Investigative Committee of the Russian Federation in the Period of Adoption of the Republic of Crimea to the Russian Federation
Abstract
The article discusses the issues related to problems in the investigation of criminal cases from experienced investigators of the Investigative Committee established in the territory of the Republic of Crimea on March 18, 2017. The contract about acceptance of the Republic of Crimea to the Russian Federation was signed by the representatives of the Republic of Crimea (including Sevastopol) and the Russian Federation on March, 2014 and contained provisions on admitting the Republic of Crimea and Sevastopol as subjects of the Russian Federation. The transition of the Republic of Crimea under Russian jurisdiction has no modern analogs, so the analysis of the problems is of interest from a theoretical point of view and is necessary from the practical one. Criminal and procedural legislation of Ukraine has significant differences in comparison with the similar law of Russia. The article shows the peculiarities of the rules of criminal procedure of Ukraine and Russia, the problems of their application and ways of overcoming these problems during the transition period of adoption of the Republic of Crimea in the Russian Federation and established legal uncertainty in connection with it. It should be noted that many of the issues related to the application of criminal procedural law in the period of transition from one legislative system to another one are not solved up to date.
