Consequences of Violation of the Limits of Freedom of the Contract
Abstract
The article discusses the limits of freedom of the contract, established by civil legislation of the Russian Federation. The authors analyze the novels of the civil legislation, establishing the principle of freedom of the contract and its limits, as well as the norms establishing the consequences of violating of the rules of conduct prescribed by law. Freedom of contract is not unlimited. Civil legislation sets reasonable limits of freedom of contract, which are not always followed by the participants of civil turnover. In practice, individual actors violate the limits of freedom of the contract, which, in particular, can be expressed in the abuse of freedom of the contract. The Civil Code sets out a variety of negative consequences of violating the limits of freedom of the contract. However, today in the field of protection of rights of participants in civil turnover, special place belongs to such methods of protection, which are aimed at the prevention of adverse effects from dishonest behavior by treaty obligations. One of such methods is the timely, complete informing of the consumer, the customer, the parties at the stage of conclusion of the contract before signing of all the terms of the contract, as well as any possible adverse effects in case of violation.
