Some Questions of the Methodology for Investigating Lewd Acts Committed against Minors Using Internet Resources
Abstract
The article is devoted to the analysis of the methodology for investigating crimes related to lewd acts against persons under 16 years of age. In the course of the disclosure of this topic, questions of the criminal-legal assessment of crimes of this category in the legislation of other countries (a number of foreign states), as well as the historical roots of responsibility for this act in domestic criminal law are investigated. In particular, the recommended algorithm for investigative actions necessary to investigate these crimes is set forth: starting with a complex of operational and investigative measures to identify the guilty party, interrogation of the injured party, the suspect, seizure of information of evidentiary value and ending with the appointment and conduct of the examination. Also, a set of measures is proposed to improve countermeasures at the international level against crimes against sexual inviolability, such as: the introduction in the Criminal Code of the Russian Federation of a separate standard providing for liability for lewd acts using the Internet; the formation in the system of law enforcement agencies of a special service aimed at combating such crimes; uniting the efforts of the international community in countering encroachments on the sexual inviolability of the individual.
