Circumstances Excluding Criminality of the Deed under the Criminal Law of the Russian Federation and Countries of Central Asia
Abstract
The present article deals with the comparative legal analysis of the criminal law of the Russian Federation and countries of Central Asia (the former Soviet Union republics: the Republic of Kazakhstan, the Republic of Uzbekistan, the Republic of Tajikistan, Turkmenistan, the Kyrgyz Republic), which regulates the circumstances excluding the criminality of the act. A certain typicality is identified in the regulation of such circumstances. These are their structural isolation (identified in separate chapters) except for the Criminal Code of the Republic of Kazakhstan; the absence of the legal definition of the circumstances excluding the crime of the act (except for the Criminal Code of the Republic of Uzbekistan); the same number of such circumstances and, in most cases, the same titles. Some features are highlighted in the regulation of certain circumstances excluding the criminality of the act. They relate to the meaningful characteristics of the particular circumstance.
This testifies to the orientation of the criminal law provision towards the law-enforcement agent with a view to eliminate an error in determining the lawfulness of the act that caused the harm to the object, which is protected by the criminal law.
