State Functions Classification in Soviet and Modern Jurisprudence
Abstract
The article represents analysis of different approaches to the classification of state functions suggested by the national jurisprudence in the Soviet and modern periods of its development. Based on comparison of state functions classifications dominating in the Marxist-Leninist theory of law to the ones represented in the modern theory of law, a number of conclusions is made. First of all, regarding the post-Soviet jurisprudence, the process of the time established classification criteria reproduction can be observed, which in case of rejection of the fundamental postulates of Soviet science is accompanied by understatement and inconsistency in the presentation of the material. Besides, the intention to propose new classification criteria for the division of state functions is obvious in the modern theory of law, more in line with the contemporary realities and at the same time based on the author's (sometimes controversial) rendering of a number of important issues (such as the nature of the state and the type of the state). Thus, the problem of the state functions classification shows weaknesses of the state functions classification theory (to what extent the determination of non-core and temporary functions of the state corresponds the concept of the state functions?) and the related topics (to what extent the determination of social and class functions of the state is applicable to the type of state?), which actualizes the need for further scientific research in this area.
