Legal and Organizational Problems of the Prosecutor's Office for Anti-Corruption Examination

Abstract

The article summarizes some of the results of the work of the Prosecutor's bodies on the implementation of a new direction of activity — anti-corruption examination of normative legal acts and projects of such acts. The author analyzed the statistical data of the Prosecutor General's Office of the Russian Federation, made conclusions about the scale of the work carried out by the prosecutor's office for 10 years. The analysis of the current federal legislation and departmental legal acts, in this regard, identified the legal and organizational problems in the activities of prosecutors, in cooperation with other subjects of the anti-corruption expertise. As a result, proposals are made to improve the legislation on the prosecutor's office, on anti-corruption expertise, and on the orders of the Prosecutor General of the Russian Federation regulating the procedure for conducting expert examinations. The conclusion is made about the possibility to expand the powers of prosecutors in carrying out this type of examination and the need to eliminate conflicts in the legislation on prosecution and countering corruption.
