To the Problem of the Systematization of the Rules for Appointment of the Penalties for the Crime, Performed in the Association, under the Griminal Code of the Russian Federation
Abstract
The article is devoted to the topic of insufficiently investigated in the science of Criminal law of the Russian Federation — the appointment of punishment for a crime committed in complicity. The rules foreseen by the Criminal Code of the Russian Federation regulating this issue are analyzed from the point of view of their division into general and special, and also from positions of the system approach. There is a difference in the rules for assigning punishment for a crime committed in complicity, from the rules of qualification of complicity in a crime and the rules on the responsibility of accomplices. Ifthe second in the criminal law is systematized in more or less full volume, then the first are dispersed under different articles of the General Part of the Criminal Code of the Russian Federation. For the construction of a system of prescriptions regulating the appointment of punishment for a crime committed in complicity, their isolation from other norms of the Criminal Code of the Russian Federation, division into general and special ones, and the establishment of interrelation and consistency of application are required. The article proposes a list of these rules. The authors also offer recommendations on overcoming the systemic nature of the norms of the Criminal Code of the Russian Federation on the imposition of punishment for a crime committed in complicity.
