Tactical Bases of Using by the Prosecution and Defense of Criminalistic Testing of Blood in the Jury Trial
Abstract
It is known that genomic examinations today daim to be the "gold standard" in proving violent crimes against individuals. However, for a number of the most implex criminal cases of crimes against a person, one place with them is taken by forensic (tracological) studies of the mechanism of the formation of blood traces. In some cases, the conclusions of such examinations have a tangible advantage over DNA analysis, again emphasizing the importance of the art of mastering the basks of judirial tactics before the achievements of scientific and technological progress, esperially in such sodal systems as "person - person." Representative in this regard are the trials conducted with the partidpation of jurors. In this artide the first part of the work is devoted to the analysis of tactical and forensic features of the use in proving in jury trial of blood tests. The problematic perspective of the study on adversarial expertise used by the author makes it possible to cover this topic in various aspects: problems of limiting the activity of accusation and defense under the conditions of the so-called procedural "filters", features of interpretation of expert opinions, presentation of "shocking" evidence to jurors. The artide suggests recommendations addressed to professional partidpants in the process, on the work with the conclusions of technical and forensic blood tests.
