Normative and Legal Correlation of Universal and Credit Cooperative Principles
Abstract
Cooperative principles are axiological norms governing the social and legal relations in the consumer cooperatives. They are universal and apply to all types and forms of cooperatives. The article considers the features of the evolution of cooperative principles in today's legal uncertainty. The principles acting as axiological attitudes reflect the direction of cooperation development. International cooperative principles more than 120 years ago by the international community in modern conditions are subject to change on a number of socio-economic and legal reasons. There are seven universal cooperative principles applicable to different types and levels of cooperation. These principles define the vectors of development of the consumer cooperation in the world. Analysis is given to legal grounds of each principle with the consideration from the position of Philosophy of Law. Separate attention is given to the principles of credit cooperation system that are not reflected in the legislation of the International Cooperative Alliance. Russian legislation in the last two decades developed a number of federal laws on credit cooperatives which present national characteristics of credit principles. The legal comparative analysis is given to these principles in the Russian cooperative legislation. Historical features of cooperation patters are identified which will help in the legal regulation of the existing credit principles.
