Features of Responsibility for Family Offenses Against Minors
Abstract
The article is devoted to the theoretical component of legal responsibility, legal nature and the essence of family legal responsibility; its general and specific attributes. The authors justify the position to distinguish family legal responsibility as an independent type of legal responsibility. The consideration is given to the concept of family legal responsibility based on the negative understanding of family legal responsibility which was formed in Family Law. The problem of family-legal responsibility is currently relevant. Public authorities pay attention to the need to enhance the warranty of the rights of children to protection. The conception of family legal parental policy states that the main objectives are: to ensure social protection of families and children needing special care of the state; to prevent family problems, to create the conditions for responsible parenthood. According to the National Strategy of Actions in the interests of children for 2012-2017, the Russian Federation must form a system that provides a response to the violation of the rights of each child without discrimination of any kind, including diagnosis of the situation, planning and taking the necessary measures to ensure respect for the rights of the child and the restoration of violated rights. To implement the above provisions, there is the Institute of family-legal responsibility which needs investigation and improvement.
