Strategies of Judicial Investigation of Cases over Theft of Funds in the Sphere of Bank Crediting
Abstract
In the article the pressing issues of classification of judicial situations and criminalistics methods of their solution applied by court are considered. The situations in the court investigation are significantly different from the situations of preliminary investigation. Identification and research of standard situations of judicial investigation gives the chance to develop for each of them the most optimum pattern of judicial actions and their sequence from the point of view of favorable change of such situation keeping in mind the objectives of criminal proceedings. The situation of the judicial investigation should be understood as the complex spatial-temporal dynamic information system, characterized by the evidence of a crime and that implicating the accused established during the pre-trial investigation and court investigation, conditions and circumstances in which the evidence is examined, determined and the new one is procured, defining the status and perspective of court investigation in implementation of justice. Judicial situations and forensic methods of their resolution applied by the court are the essence of criminalist characteristics of the judicial investigation.
