Some Aspects of Legal Protection of Subjects of Operational Implementation
Abstract
The purpose of the article is to develop proposals to improve the legal protection of persons involved in the operational implementation. The author analyzes the norms of the Federal law “On the Operational-Investigative Activity", as well as the judgments of individual authors on the legislative regulation of legal protection of subjects of operational implementation; touches upon the issues of Prosecutor's supervision over operational-investigative activity. Attention is drawn to the fact that the introduced person is forced in certain situations to perform actions containing signs of socially dangerous acts provided by the criminal law. Taking into account the real possibility of bringing to criminal responsibility of subjects of operational introduction for the actions performed by them at accomplishment of the operational task, the offers are put forward to add to the Criminal Code of the Russian Federation a new circumstance excluding crime acts - "Conducting Operational Investigative Activities in the Criminal Environment", and also the offer to modify and complete article 21 of the Federal law "On the Operational Investigative Activity" is expressed.
